Wedding Photography Contract and Agreement  
I want your day to run as smoothly as possible. To help achieve this, I ask you to provide the following information, then sign and date the contract below. Once this is completed, return it to myself with the deposit required to reserve your big day.

TERMS AND CONDITIONS:
Pictures will begin 2 hours prior to ceremony start time, sharp unless otherwise agreed by both parties.
All parties wishing to be in the pictures are asked to remain as a group during the full duration of the photography session. Finding wandering wedding party members is far too time consuming. I will not hesitate to take cell phones away from the wedding party if they are causing distraction and delay.

Photographer set up time will be 30 minutes prior to picture start time. I will ask that you have one person of your choosing  helping me “call off the shots”.  This should be someone that knows the majority of the wedding party and family.  I cannot remember everyone’s name and role for that day, so this will make sure I don’t skip anything.  If there are 2 shooters for the event, we will have one shooting and one arranging the shots.


It is asked that the photographer be allowed to attend the ceremony rehearsal to observe the flow and order of the service. Candid pictures will be taken

Exclusive Photographer.  The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding.  Family and friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with the Photographer’s duties and do not photograph poses arranged by the Photographer.  Photographer has the right at any time during the event to ask others taking pictures to be respectful and even cease their actions if it is interfering with the flow of the day.

You are ENCOURAGED to voice your ideas– this is your day, make it as special as you’d like it to be. This is why we need to have a planning meeting at least 2 weeks prior to your wedding day.  Bring whomever you wish and a list of what you like and what you don’t like!  I want this to be YOUR day, it has very little to do with me!


Copyright and Reproductions.  The Photographer shall retain the right to use the images.  Client will be given a print and usage release and permission to print form to present should there be any problems with using images.  My logo will be small and as non-intrusive as possible.  Copyright is still owned by DixieClicks Photography.


By allowing DixieClicks Photography to photograph  your wedding, you are allowing for your images to be used (without identifying information) in portfolios and advertising. All your photos will be posted in an online album, for no less than 1 month. If there are children under the age of 18 in or at your wedding, this contract covers permission to photograph and use the images from the event as part of the right of promotion by DixieClicks Photography

Client’s Usage.  The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer until payment in full is received. At that time client will receive a letter indicating that they have usage righs to the material. I will not release the images until balance is paid in full.  The copywrite of the images remains with DixieClicks Photography.


By signing this contract, you agree to hold DixieClicks Photography harmless in the event of any personal damages. If you are unhappy with your photos, we will be happy to work this out to the best of our ability. You are also releasing DixieClicks Photography and any associates from liablilty of injury.  If you trip on a prop, you are responsible for your treatment.  I am insured for my person and equipment and wil not hold you liable for DixieClicks Photography, its associates, or equipment unless intentional or deemed irresponsible on your part.

Deposit and Payment.  The Client shall make a $250 deposit (or other amount arranged at time of contract signing) to retain the Photographer to perform the services specified herein.  At such time as this order is completed, the deposit shall be applied to reduce the total cost and Client shall pay the balance due.  If the Client refuses to pay within thirty (30) days of completion of  order, Client shall be in default hereunder and shall pay $30 per month in late fees in addition to the unpaid balance until payment is made in full. The deposit will be applied to the total package price.

You will be sent or emailed a statement explaining how charges have been applied, and the remaining balance.
Payment of Cash or  Personal Check or Paypal will be accepted
Please allow 6-8 weeks for pictures to be edited and completed. I am a 1 woman show and I want your images to be perfect!
No images or previews will be released until balance of invoice is paid in full.  However, I tend to send “sneak peaks” soon after the event to put your mind at ease!
1 USB drive containing all images is included in price.  Additional may be purchased at $50 each

Failure to Perform.  If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement.   This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.  In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
 
Miscellany. This Agreement incorporates the entire understanding of the parties.  Any modifications of this Agreement must be in writing and signed by both parties.  Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement.  The laws of the State of South Dakota shall govern this Agreement
